1. Agreement to Terms
By accessing tirewheelx.com or any of its localized subdomains (including stockton.tirewheelx.com), you agree to be bound by these Terms and Conditions. These terms constitute a legally binding agreement between you and Tire Wheel Auction LLC.
2. Localized Delivery Protocols
Tire Wheel Auction LLC utilizes independent contract drivers for localized fulfillment. Delivery terms are as follows:
Hand-to-Me Delivery: The driver will hand the products directly to the customer or an authorized representative.
Drop-off Delivery: If the customer selects or requests "Drop-off," the driver will leave the products at the provided address.
Proof of Completion: The driver is required to take a photograph of the products at the delivery location. This photograph serves as definitive proof of delivery.
Transfer of Risk: Once the photo is captured and the delivery is marked complete, Tire Wheel Auction LLC and its contractors are released from all liability. We are not responsible for theft, loss, or damage (including weather-related damage) occurring after the drop-off.
- Delivery Access & No-Shows For "Hand-to-Me" delivery orders, if the driver is unable to reach the customer after 1 attempt or a 5-minute wait at the property, the delivery will be marked as "Failed."
A $7.99 Redelivery Fee will be applied to the order for a second delivery attempt.
Alternatively, the order may be cancelled, and a refund issued minus the original delivery fee and a 15% restocking fee.
3. Product Fitment and Installation
Tire Wheel Auction LLC is a retailer and delivery service only.
Customer Responsibility: You are solely responsible for verifying that the tire/wheel specifications (bolt pattern, offset, load rating, etc.) are correct for your vehicle.
No Installation: Unless explicitly stated in a separate service agreement, we do not provide installation. We are not liable for any damage to products or vehicles occurring during third-party installation.
4. Returns & Cancellations
Condition: Returns are only accepted for tires/wheels that have not been mounted. Once a tire is mounted to a rim or a rim is mounted to a vehicle, it is "used" and ineligible for return.
Fees: Returns are subject to a 15% restocking fee. Original delivery fees are non-refundable.
5. Limitation of Liability
To the maximum extent permitted by California law, Tire Wheel Auction LLC shall not be liable for any incidental, consequential, or punitive damages, including but not limited to property damage caused by contract drivers or product failure after installation.
6. Venue and Jurisdiction
These Terms are governed by the laws of the State of California. Any legal action or proceeding related to your use of this site or our services shall be brought exclusively in a federal or state court of competent jurisdiction sitting in San Joaquin County, California.
